These Terms of Service ("Terms") govern your use of OpenGill, a personal financial-guidance application operated by Tricor Capital LLC ("OpenGill," "we," "us," or "our"). By accessing or using OpenGill, you agree to these Terms. If you do not agree, do not use the service.
OpenGill helps you understand your finances and plan toward your retirement goals by analyzing account information you choose to connect and information you provide. OpenGill is currently offered on a limited, private-beta basis.
OpenGill provides general, informational guidance only. It is not a registered investment adviser, broker-dealer, financial planner, accountant, or law firm, and nothing it provides constitutes financial, investment, tax, accounting, or legal advice. OpenGill does not recommend the purchase or sale of any specific security. You are solely responsible for your financial decisions, and you should consult a qualified licensed professional before making them.
Your use of OpenGill does not create an advisory, fiduciary, or professional-client relationship between you and Tricor Capital LLC.
You may connect financial accounts through Plaid. You represent that you are authorized to connect any account you link. OpenGill's access is read-only and cannot be used to move money or initiate transactions. Your use of Plaid is also governed by Plaid's applicable terms and privacy policy.
You agree to use OpenGill only for lawful, personal purposes, to provide accurate information, to keep your access credentials secure, and not to attempt to disrupt, reverse engineer, or gain unauthorized access to the service.
OpenGill is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any insight it provides is accurate or complete.
To the maximum extent permitted by law, Tricor Capital LLC and its owners and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, OpenGill.
You agree to indemnify and hold harmless Tricor Capital LLC from any claims or expenses arising out of your misuse of the service or your violation of these Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of OpenGill after changes take effect constitutes acceptance of the revised Terms.
